A federal appeals court has cleared the way for the National Football League to suspend Dallas Cowboys running back Ezekiel Elliott six for a domestic violence case in Ohio.

Because the Cowboys do not play this week, the union has more time to file motions before Elliott's suspension might affect his chances of playing in a game. Elliott could still avoid the suspension for now if the NFLPA files for a temporary restraining order in the Southern District of NY and the court grants their request. Dallas next plays October 22 in San Francisco.

In the wake of today's ruling, the NFLPA is expected to re-file the case with the U.S. District Court for the Southern District of NY and could seek a temporary restraining order and preliminary injunction which would allow Elliott to keep playing, according to Gabe Feldman, director of the Tulane Sports Law Program (H/T NFL).

The judges voted 2-1 to grant the NFL's emergency request and ordered the U.S. Eastern District Court in Sherman to dismiss Elliott's case.

Elliott would miss games against the 49ers, Washington Redskins, Kansas City Chiefs, Atlanta Falcons, Philadelphia Eagles and Los Angeles Chargers if the suspension, which is without pay, stands and is enforced from this point forward.

Mazzant ruled that Elliott did not receive a fair appeal hearing before Henderson, in large part because Elliott's accuser and Goodell did not testify. Elliott has denied the charges.

The NFL announced the suspension in August after a yearlong investigation found that on three occasions, Elliott caused physical injury to a girlfriend.

Elliott, the league's leading rusher last season as a rookie, has totaled 393 rushing yards in five games this season.
