"This tragedy could have been prevented if San Francisco had simply turned the alien over to ICE, as we requested, instead of releasing him back onto the streets". The fact that San Francisco Sheriff's Department, months before the shooting, had refused to tell federal immigration officials when undocumented Garcia Zarate was to be released from jail made it a touchstone in the national debate on sanctuary cities.

Prosecutors had argued Garcia Zarate intentionally shot Steinle, 32, with a Sig Sauer.40-caliber handgun as she and her father walked on San Francisco's Pier 14.

But he told jurors that Garcia Zarate had no motivation to kill Steinle and as bad as her death was, "nothing you do is going to fix that".

President Donald Trump said during the presidential campaign that Steinle's death was another reason the United States needed to build a wall on its southern border and tighten its immigration policies.

"The Department of Justice will continue to ensure that all jurisdictions place the safety and security of their communities above the convenience of criminal aliens", Sessions said. "I urge the leaders of the nation's communities to reflect on the outcome of this case and consider carefully the harm they are doing to their citizens by refusing to cooperate with federal law enforcement officers".

Trump has said that Steinle's death, just two weeks after he launched his presidential campaign, is emblematic of the problems in the USA immigration system, particularly the continued existence of sanctuary cities where local officials refuse to cooperate with federal immigration officials.

The jury found him not guilty of the assault charge but convicted him of the possession charge. The bullet ricocheted on the pier's concrete walkway before it struck Steinle. The administration has appealed. He said it was wrapped in cloth, and when Garcia Zarate unwrapped it, the gun accidentally discharged. Such cities often do not use municipal funds or resources to enforce federal immigration laws.

Zarate most recently served five years in a federal prison in Victorville, Calif.

Gillian Christensen, an ICE spokesperson, has said the detainer wasn't honored.

Assistant District Attorney Alex Bastian said prosecutors were disappointed in the verdict but respected the jury's decision. "She would still be alive today if her killer had been imprisoned or deported, as he should have been".
