Muslim Clerics Urge to Withdraw Triple Talaq Bill

  • Ahead of Parliament tabling Triple Talaq bill AIMPLB holds emergency meeting

After a detailed discussion on the Bill during an emergency session of its 51-member working committee on Sunday at Nadwa College in Lucknow, the Board has unanimously made a decision to reject and oppose the bill in its present form. This is a big conspiracy. "If this Bill becomes a law, women will face a host of difficulties", AIMPLB spokesperson Maulana Khalil-ur-Rehman Sajjad Nomani said.

AIMPLB, being a self-proclaimed representative body of Indian Muslims should have come up with their own version of draft bill instead of just condemning or requesting central government to withdraw it but as usual, they failed to give a concrete solution. "Even Saira Bano has not taken custody of her children till date", said Jilani while objecting to provision in the proposed bill that anyone can complain about the husband even if divorced wife does not want to file a case against the estranged husband.

After the Supreme Court declared the practice of instant divorce "void, illegal and unconstitutional", the Prime Minister Narendra Modi led Cabinet on December 15 approved the bill that makes instant triple talaq illegal.

"The objective of the bill is inconceivable as the Shariat (the book on Islamic laws), as it is, deems triple talaq illegal", Jilani commented.

"The board believes that the bill is against the Constitution, the rights of women and Shariah". The onus now shifts to our parliamentarians to examine the Bill, and one hopes they will act with the same alacrity that they did when they summoned Sanjay Leela Bhansali in November in connection with his film Padmavati, which was facing protests, and asked him to assure them that the honour of a Hindu woman would not be besmirched. "If the government feels that it is very important, then it should first speak to the Muslim Personal Law Board and Muslim women organisations", Nomani said. Hence, the government will now reintroduce the bill. Union Minister Ravi Shankar Prasad will introduce the bill in the Rajya Sabha.

The bill defines triple talaq as "any pronouncement (of divorce) by a person upon his wife by words, either spoken or written or in electronic form, or in any other manner". "We will help in solving the issues under the constitutional provision of Muslim laws".

"Rs Rs The AIMPLB will opposed the bill at every level and run a awareness campaign against it since the proposed Legislation will adversely affect the muslims men and women and infringement on the rights granted to the minorities in Article 25 of the constitution", said Maulana Sajjad Nomani.

The minister said the bill was drafted keeping in mind humanitarian angle, not on the basis of religion.

There is also a provision of imprisonment for a term which may extend to three years and fine for violators.

The triple talaq Bill removes this much needed layer of judicial oversight when it comes to Muslim men, for by making the offence cognizable, it gives police officers the power to conduct an investigation without bringing it to the notice of the concerned magistrate forthwith.
