No constitutional crisis, only procedural problems, says Justice Kurian

  • Supreme Court judges J Chelameswar and Ranjan Gogoi speak at a press conference

They warned that democracy was under threat. They also said that the issue can not linger on for an indefinite period.

The four judges had in an unprecedented press conference yesterday mounted a virtual revolt against the CJI, listing a litany of problems including the assigning of cases.

The press conference was called at Justice Chelameswar's residence here at Tughlaq Road.

So, the question is; if they haven't sold their souls, then who has.

Justice Chelameswar ordered a hearing on the petition at 12.45 pm and issued an order to place the petition before a five-judge bench in which the CJI and the next four most senior judges involved. Without going specific, the letter that the judges produced, read "having far-reaching consequences for the nation and the institution had been assigned by the Chief Justice of this court selectively to the benches "of their preference" without any rational basis for such assignment".

In their letter they referred to certain particular cases where cases were delayed for no reasons.

The BJP and Shah's office declined to comment. And why not? That bench before which the case is posted does not have only person. I'm very upset about this, I wish the four Supreme Court judges hadn't done this. It is learnt that Venugopal advised Misra to show restraint and not respond immediately.

Srinagar:Expressing deep concern over the developments which forced four honorable Supreme Court judges to make public their observations over functioning of Supreme Court, AIP Supremo and MLA Langate Er.

The latest move unfolds as one of the apex court judges Justice Mohan M Shantanagoudar is on leave.

Judge Loya was hearing the Sohrabuddin Sheikh alleged fake encounter case when he died under "mysterious" conditions.

However, the Judges declined to elaborate on the Loya case. Now this is a scary proposition. "It is quite simply an issue that should concern every single Indian". There have been talks of lower judiciary in India being severely compromised.

Gogoi said this on the sidelines of a programme when asked about the way forward to resolve the present crisis with the judiciary. Bureaucracy, Media, Election Commission and now Supreme Court. "It was an internal affair of the judiciary", BJP spokesperson Sambit Patra said. "Let's not politicise the Supreme Court". "So no, it's not an internal matter for the Hon SC", Abdullah said. Political parties must come out in full force to save the democracy and the rule of law. The government, on its part, is looking at bringing about a compromise and nipping the issue in the bud. The attempts will be to weaken and batter them by motivated media and investigating agencies. He had for some time been opposing the Collegium system and had complained that judicial appointments were many a time being made arbitrarily and to dole out favours to some people.

The nation must know who manipulates the CJI and what hidden power does the Modi government exercise over the CJI?
