No evidence border patrol agents were attacked

The FBI in El Paso said Wednesday it can not find any evidence that an attack led to his death.

Martinez, 36, died late on the evening of November 18.

Martinez, a native of El Paso, had been a border patrol agent since August 2013. "To date none of the more than 650 interviews completed, locations searched, or evidence collected and analyzed have produced evidence that would support the existence of a scuffle, altercation, or attack". Disoriented and unsure of his location, Garland told the dispatcher that he and Martinez were injured.

A spokesman for the National Border Patrol Council, the union that represented the officers, said it was an "ambush".

"The dispatcher made a notation in the Border Patrol log "[He] thinks they (both agents) ran into a culvert", according to the report.

Neither she nor the Martinez family had heard from Garland since the agent's death, she said.

"We believe it was an assault on our agents and a murder of one of our agents and an attempted murder of another", he said.

Sen. Ted Cruz, R-Texas, called the incident "a stark reminder of the ongoing threat that an unsecure border poses". The reward for information has been raised to $50,000, and tips can be called into the El Paso office at 915-832-500.

Rogelio Martinez died from injuries sustained in November past year while responding to reports of a late-night incident near Interstate 10 in remote west Texas, about 30 miles from the border with Mexico.

He pointed to the lack of injuries on the lower part of Martinez's body.

But an update from the FBI on its investigation complicated the picture.

Concentrated investigative activities and canvasses for witnesses and evidence have taken place across the United States. A total of 26 searches have been carried out in Texas and New Mexico. Investigators also talked to six employees of Union Pacific Railroad, which had locomotives in the area.

Rogelio Martinez died while patrolling in the Big Bend Sector of the border in Texas.

"I just feel like the Federal Bureau of Investigation isn't doing what they're supposed to be doing", she said, adding that she believes the FBI is investigating the wrong person.

The Medical Examiner was not, however, able to determine the manner of death - meaning that an accidental death was not ruled out after autopsy.

Shortly after Mr Martinez's death, Culberson County Sheriff Oscar Carrillo cast doubt on the notion that the agent had died in an attack. The defendants are innocent until proven guilty in a court of law. "As part of this effort, the FBI has investigated multiple theories, including whether the Border Patrol Agents were ambushed or attacked or whether their injuries were as a result of an accident or any other relevant criminal activity".
