A federal judge ruled Monday that Facebook must face a class action lawsuit brought by site users in IL who aren't down with the use of facial recognition technology. Users sued in 2015 in a class-action lawsuit, which finally came into legal fruition earlier today, so to speak. Specifically, Facebook has created, collected and stored over a billion "face templates" (or "face prints") - highly detailed geometric maps of the face - from over a billion individuals, millions of whom reside in the State of IL.

At the heart of the issue is a 2008 state regulation known as the Biometric Information Privacy Act, which prohibits the collection or use of biometric data without precise public disclosure.

"As more people become aware of the scope of Facebook's data collection and as consequences begin to attach to that data collection, whether economic or regulatory, Facebook will have to take a long look at its privacy practices and make changes consistent with user expectations and regulatory requirements", Shawn Williams, the plaintiffs' attorney, told Bloomberg.

Federal judge James Donato, based in San Francisco, ruled Monday that a class action lawsuit would be the best way to deal with the issue, though participants are limited to those who lived in IL and were the subjects of a Facebook "face template".

The news comes as the social networking giant continues to face scrutiny over its data collection practices in the wake of the Cambridge Analytica scandal, which has seen founder and chief executive Mark Zuckerberg face two days of questioning from U.S. politicians.

"So how does Facebook know that a face in a photo belongs to someone who hasn't consented to facial recognition?"

Facebook can probably recognize that its users' faces are angry.

Cobbe said she believes Facebook's implementation will fall afoul of GDPR, because it will have to scan every face in photos just to see if the photo subjects have consented to use of the tech. The feature which is not available to users in most countries, can be turned off in settings for users in the United States.

"If you've never been tagged in a photo on Facebook or have untagged yourself in all photos of you on Facebook, then we do not have this summary information for you", the help page says.

According to the report, the information that was accessed by "Bumble" included a person's friends list, relationship status, current location and friends a user had in common with other Bumblers.
