Judge slaps Kris Kobach with contempt of court in voter registration case

Kobach is one of the USA' most prominent voter fraud crusaders along with a adviser to President Donald Trump on the problem.

The would-be voters submitted their applications at DMV offices, without providing documentary proof of citizenship, like a birth certificate or passport, as required by the state law Kobach argues Kansas needs to prevent voter fraud.

Instead of a fine in the contempt matter, Robinson ordered Kobach to pay attorneys fees for the plaintiffs in the case. Robinson stated Kobach failed to follow her order to treat voters impacted by the proof-of citizenship law like other voters and send them the standard postcards about their registration.

"The term "register" is not ambiguous, nor should there have been any question that these voters were to be treated just like any other registered voter prior to the 2016 election", she wrote.

The organization also wanted Kobach to correct erroneous and misleading information in the state's official election manual to make clear that, for now, those voters are exempt from the state's proof-of-citizenship requirements.

In her ruling, U.S. District Judge Julie Robinson in Kansas City, Kan., referred repeatedly to Kobach as acting "disingenuously".

Two of Kobach's witnesses have said that since 2000 Kansas has identified 127 people who are believed to be non-citizens when they registered or attempted to register, the ACLU said.

Judge Robinson also noted that before the he was put to trial, Kobach exhausted to maintain he was not obligated to send out postcards only to later change stance, claiming he "orally" instructed his staff to do that. Rather than correcting information in the online election manual, Kobach removed it from the secretary of state's website.

After Robinson reasoned he strove to deceive the court on records regarding a 2016 interview Kobach was fined $ 1000 final year.

Kobach assured the judge he will send postcards, which hold information about polling stations, to affected voters but they were never sent. The lawsuit Fish v. Kobach is still pending.

"Defendant has a history of non-compliance with the preliminary injunction order", wrote the judge in her 25-page contempt order.

Rep. Keith Esau, an Olathe Republican who is running for secretary of state, defended Kobach.

Kobach spokesman Moriah Day said the secretary of state's office would be appealing Robinson's decision. He had registered in the state two years earlier but was humiliated when he went to vote in the 2014 elections and was told he needed to cast a provisional ballot because he wasn't on the voter rolls.

Dale Ho, the ACLU's top voting rights lawyer who fought the case against Kobach said the Kansas governor candidate talks a big game but when it comes to abiding by law, his actions speak louder than words.
