Avenatti defends right to release Cohen's financial info

  • Stormy Daniels's lawyer defends release of Cohen Bank data

The reason for this is that Cohen allegedly communicated with Daniels' former lawyer Keith Davidson regarding her hush agreement regarding her alleged affair with Trump, and she wants those communications protected.

Michael Avenatti, the attorney representing adult film star Stormy Daniels, argued in a court filing Monday that the First Amendment protected his release of financial records pertaining to President TrumpDonald John TrumpRomney denounces pastor slated to speak at U.S. embassy in Jerusalem Pentagon finds problems with Kushner-backed health program: report Apple CEO Tim Cook praises Parkland, "Me Too" activists in commencement speech MORE's longtime lawyer, Michael Cohen. For example, Novartis and AT&T have since acknowledged they paid Cohen for access to the president.

"Even if Mr. Cohen's allegations were true (and they are not), laws restricting disclosure of banking information and suspicious activity reports (SARs) apply to financial institutions and government entities, not third parties", Avenatti wrote. "You end up becoming thrown aside, and I have a feeling she's just a conduit... for his fame". According to Avenatti, one of the men is Ahmed Al-Rumaihi, the head of a division of Qatar's sovereign wealth fund who has been accused in a lawsuit of trying to bribe Trump administration officials.

But Avenatti's revelations left some legal observers wondering what exactly they have to do with his efforts to free Daniels from the non-disclosure deal she says was improperly executed, or to intervene in the criminal proceedings against Cohen now underway in Manhattan.

Earlier Monday, Avenatti, a California lawyer, asked a judge to let him represent his client, whose real name is Stephanie Clifford, in litigation over Cohen's records in NY federal court.

Lawyers for Cohen have objected, and Judge Kimba Wood is mulling the issue. Avenatti argued that the documents are of the "utmost public concern".

Cohen's lawyers claimed that parts of Avenatti's document was untrue, and that it referenced a number of wire transfers and transactions that Cohen himself was never involved in. Or she might say, you can be in it and I'll subject you to a strict gag order: "no TV, no Twitter".

Cohen's attorneys did not respond to a request for comment on Avenatti's memo. Avenatti declined to go on Tucker Carlson Tonight, but told McNally he'd "be happy to" appear on Sean Hannity's show. "And ultimately, people can decide whether it's credible or not or whether there should be follow-up investigation or not". "They should get used to it, 'cause we're not changing".
