However, if new DNA evidence emerges, the case may be prosecuted after the 10-year mark. Under California's statute of limitations, an allegation dating back to the 1990s can not be charged, the Los Angeles Times reports.

The case was presented by the Santa Monica Police Department, according to KABC.

Sylvester Stallone accepts the Best Supporting Actor award for "Creed" at Critics' Choice Awards on January 17, 2016 in Santa Monica.

In December, the 71-year-old Rocky star was accused of sexually assaulting a woman during an alleged meeting at his office in 1990. He will reprise his role as Rocky Balboa in "Creed 2", November 21. The girl stated that Stallone would "beat her head in" if she told anyone about the incident.

The increasing scrutiny on allegations against Stallone come in the wake of the #MeToo movement and reports about widespread sexual abuse allegedly perpetrated by Harvey Weinstein and other powerful men in Hollywood.

A woman claimed the action hero raped her decades ago and she filed a police report with the allegations in November.

Stallone's lawyer, Marty Singer, said at the time that the actor "categorically disputes the claim".
